Initial Application

If you have decided to pursue SSDI benefits, the process begins with the initial application, which involves filling out an extensive amount of paperwork. You then submit the paperwork to the Social Security Administration (SSA), which obtains your relevant medical records. All the information is evaluated and a determination made as to disability. At this level, the majority of claims are denied.

When we file the initial application as your attorney, we know how to respond appropriately to the Social Security Administration’s initial inquiries. We begin building your case from the initial application.

Request for Reconsideration

If your initial application is denied, you then have 60 days to request reconsideration. If you opt to request reconsideration, a different person at the SSA makes the determination. Again, at this level, the majority of claims are denied.

At the reconsideration level, we thoroughly review the Social Security decision for errors before moving for reconsideration.

Hearing

If your claim is denied at the reconsideration level, you have 60 days to request a hearing before an Administrative Law Judge (ALJ). At the hearing, in addition to your testimony, the ALJ will hear from a government vocational expert and usually a government medical expert. If you are represented by an attorney, he or she will be able to cross-examine those experts.
